THE LIABILITY OF THE TRANSPORTER FOR LOSSES SUFFERED BY TOURISTS-PASSENGERS DUE TO ROADWAY ACCIDENTS
ABSTRACT
This study aims to examine the liability of transport carriers for losses suffered by tourists as a result of road accidents and to explore dispute resolution regarding those losses. This research is classified as normative juridical research, characterized by a descriptive nature with data sourced from literature. The analysis is conducted through descriptive and qualitative methods. The findings of this research conclude that the transporter’s liability for losses sustained by tourists due to roadway accidents is stipulated by legislation that outlines several obligations that the transporter company must fulfill in conducting its business. In the case of violations during the execution of these obligations, the carrier company is fully responsible. These responsibilities include: accountability for lost or stolen goods and the obligation to compensate the owner for any losses incurred; liability for wrongful acts committed by drivers or their employees; and accountability for all contractual obligations, including the resolution of all legitimate claims. Furthermore, there are two avenues available for resolving disputes concerning losses suffered by tourists due to roadway accidents: litigation and non-litigation routes.
